Royal Decree 106/2008 of 1 February on batteries and accumulators and the environmental management of their waste and its subsequent Royal Decree 710/2015, establishes the technical and ecological quality conditions that must be respected in the collection and management of this waste, in accordance with Directive 2006/66/EC of the European Parliament and of the Council of 6 September 2006 on batteries and accumulators and batteries and accumulators waste.

For the purposes of the application of this Royal Decree, the Collective System of Expanded Producer Responsibility may establish Collaboration Agreements with Local Bodies and Autonomous Communities.

Framework agreements

The purpose of signing the Framework Agreements is to establish the collaboration framework that must govern the activity of the signatory Collective Waste Management Entities of the Collective Waste Systems of Batteries and Accumulators (hereinafter the SC of RPA) and their relationship with the local entities and the Autonomous Community in accordance with their competences, in order to ensure compliance with the requirements of Royal Decree 106/2008, on Batteries and Accumulators and Environmental Management of their waste, in Royal Decree 943/2010 of 23 July, which modifies it and other legal regulations that apply to this type of waste.

Ecopilas maintains a fluid communication and constant dialogue with the different Administrations to encourage the signing of these framework agreements.

Bilateral agreements

For those Communities that do not have a framework agreement, Ecopilas offers Local Entities to collaborate with Ecopilas through the signing of bilateral Agreements. These agreements will be voluntary and their objective is that the financing of the management of these wastes with specific regulations is assumed by the producers of batteries and therefore without cost for the local entities.

How the legislation affects me

In accordance with the provisions of Royal Decree 106/2008 of 1 February on batteries and accumulators and the environmental management of their waste, all the costs of the collection and management operations of this waste, including selective collection, transport, classification, temporary storage, treatment and recycling, will be borne by the producers, in accordance with the management system used.

For the purposes of the application of this Royal Decree, the Collective System of Expanded Producer Responsibility may establish Collaboration Agreements with Local Bodies and Autonomous Communities.

What does Ecopilas offer local authorities?

Comprehensive management at no cost for the local entity through the signing of bilateral collaboration agreements between Ecopilas and EELL the financing of the management of these wastes will be assumed by the producers of batteries and therefore at no cost for the local entities.

We adapt to your needs according to the type of management of this waste by the local authority, Ecopilas has two modalities of bilateral agreement:

The local authority does not have a battery collection service: Ecopilas would take on the management of the entire process:

• • • Capillary collection at the points enabled by the local authority.
    • Supply of the necessary containers.
    • Transport to intermediate storage point and final management in plant.

The local authority collects battery waste from several points (capillary collection) and gathers it at a storage point: in cases where the local authority collects battery waste (capillary collection) through authorised managers or through its own means (municipal services) and gathers these collected in a grouped manner at a storage point (clean point, ecopark, etc.), Ecopilas will assume:

• • • Collection grouped in the points enabled by the local entity (clean points, ecoparks, warehouses).
    • Supply of drums for storage points.
    • Supply of the necessary containers (cardboard) for the capillary collections carried out by the local authority.
    • Transport to final management plant.
    • Compensation to the local entity: given that the local entity performs the first stage of waste management, capillary collection, Ecopilas would compensate the EELL with an amount established in agreement so that the management of portable batteries does not involve any cost for the local entity.
